By using the website, you acknowledge that you have read this Privacy Policy. Where consent is required by applicable law, we will ask for your consent separately.
1. Personal Data We Collect
We may collect information that you provide directly to us, including your name, email address, telephone number, professional role, company name, company website, startup stage, fundraising plans, business information, and other information you choose to provide through application forms, assessments, scorecards, questionnaires, contact forms, email, or other communications.
When you complete a Fundable Circle application, Eisen Fundability Score assessment, or another business evaluation, we may also collect information about your startup, including product status, market, traction, customers, team, fundraising history, capital requirements, business model, and other information relevant to evaluating the company.
If you become a client, we may collect additional information necessary to provide advisory or consulting services, manage our relationship, arrange meetings, provide investor introductions, issue invoices, process payments, and maintain business records.
Payment card or banking information may be processed directly by third-party payment providers. We do not intentionally store full payment-card details on the Fundable Circle website.
We may also automatically receive certain technical information when you use the website, such as your IP address, browser type, device type, operating system, referring website, pages visited, approximate location derived from your IP address, timestamps, and information collected through cookies or similar technologies.
We may occasionally receive professional contact information about you from referrals, business partners, investors, publicly available professional sources, or professional networking platforms where permitted by applicable law.
We do not intentionally collect special categories of personal data such as information concerning health, religion, political opinions, racial or ethnic origin, biometric data, or sexual orientation. Please do not provide such information unless it is specifically necessary and requested.
2. How We Use Personal Data
We process personal data only when we have a lawful basis for doing so.
We use information submitted through applications, assessments, scorecards, and inquiries to evaluate your company, respond to your request, determine whether our services may be appropriate for you, prepare for conversations with you, and potentially enter into or perform a business relationship. The legal basis is taking steps at your request before entering into a contract and, where applicable, performing a contract.
We use information relating to existing clients to provide Fundable Circle advisory services, assessments, strategic guidance, fundraising support, investor matching, introductions, communications, and related services. The legal basis is performance of our contract with you and our legitimate interest in properly managing our client relationships.
We may use your business and contact information to communicate with you about your application, assessment results, meetings, services, transactions, or other matters you have requested.
Where you have requested or authorized investor introductions, we may use and share relevant information about you and your company with selected investors, venture funds, business partners, or other parties for the purpose of facilitating such introductions.
We may use technical and usage information to operate, secure, maintain, troubleshoot, analyze, and improve the website and our services. The legal basis is our legitimate interest in operating a secure and effective business and website.
We may send newsletters, fundraising insights, educational content, program information, or other marketing communications where you have subscribed or where another lawful basis permits us to do so. Where consent is required, the legal basis is your consent. You may unsubscribe at any time.
We may also process information when reasonably necessary to prevent fraud or misuse, protect our legal rights, resolve disputes, maintain records, comply with tax or accounting requirements, respond to lawful requests from authorities, or comply with other legal obligations.
3. Fundability Assessments and Scoring
Fundable Circle may provide assessments, benchmarks, questionnaires, or scoring tools, including the Eisen Fundability Score, that evaluate information supplied by founders about their companies.
Some scores or results may be calculated automatically from the answers provided. These tools are intended to provide business and fundraising guidance.
They do not constitute investment decisions, credit decisions, legal determinations, or other decisions producing legal or similarly significant effects concerning an individual solely through automated processing.
Assessment results should not be interpreted as a guarantee that a company will receive investment or successfully raise capital.
4. Cookies and Similar Technologies
The website may use cookies and similar technologies necessary to operate the website, maintain security, remember preferences, understand website usage, and, where enabled, measure marketing effectiveness.
Some cookies may be placed by service providers that support the operation of the website.
Where required by applicable law, non-essential analytics, advertising, or marketing cookies will be used only after you have provided the appropriate consent.
You may also control cookies through your browser settings. Blocking certain essential cookies may affect the functionality of the website.
5. How We Share Personal Data
We do not sell or rent personal data to third parties.
We may share personal data with service providers that assist us in operating our business, including website hosting and technology providers, email and communication providers, scheduling providers, CRM or business-management providers, analytics providers, payment processors, professional advisers, accountants, and legal service providers.
Our website is built and hosted using Base44, which provides application hosting, infrastructure, security, and related technology services and may process personal data on our behalf.
Where you request or authorize an investor introduction, we may provide appropriate information about you and your company to selected investors, venture capital firms, strategic partners, or other relevant parties.
We may also disclose information where required by law, regulation, court order, governmental request, or where reasonably necessary to protect our rights, users, business, property, or safety.
If Fundable Circle or substantially all relevant business assets are acquired, reorganized, merged, financed, or transferred, personal data may be transferred as part of that transaction subject to applicable data-protection requirements.
6. International Data Transfers
Fundable Circle operates internationally, and some of our service providers may process information in countries different from the country where you live.
As a result, personal data may be transferred outside the European Economic Area (“EEA”), United Kingdom, or other jurisdictions that have specific rules governing international transfers.
Where required by applicable law, we use legally recognized mechanisms designed to protect personal data transferred internationally, which may include adequacy decisions, Standard Contractual Clauses approved by the European Commission, contractual safeguards, or other lawful transfer mechanisms.
7. Data Retention
We retain personal data only for as long as reasonably necessary for the purposes for which it was collected and as required by applicable law.
Information relating to inquiries, applications, or assessments that do not result in an ongoing client relationship will normally be retained for up to 24 months after our last meaningful interaction, unless a longer period is reasonably necessary for legal, security, dispute-resolution, or business-record purposes.
Information relating to clients may be retained for the duration of the client relationship and afterward for the period required to comply with legal, contractual, accounting, tax, professional, or dispute-resolution requirements.
Marketing information may be retained until you unsubscribe or withdraw your consent. We may retain limited information documenting an unsubscribe request so that we can respect your communication preferences in the future.
When information is no longer required, we may delete, anonymize, or securely archive it as appropriate.
8. Your Rights Under GDPR
If GDPR or similar data-protection legislation applies to you, you may have the right to request access to the personal data we hold about you, request correction of inaccurate data, request deletion of personal data in certain circumstances, request restriction of processing, receive certain data in a portable format, and object to certain processing based on legitimate interests.
Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.
You also have the right to object at any time to the use of your personal data for direct marketing. If you unsubscribe from our marketing communications, we will stop sending those communications.
These rights may be subject to limitations and exceptions under applicable law.
To exercise a privacy right, contact us at office@leoneisen.com. We may need to verify your identity before completing your request.
We will respond to valid requests within the period required by applicable law.
9. Right to Lodge a Complaint
If you are located in the EEA, you have the right to lodge a complaint with the data-protection supervisory authority in the country where you live, work, or believe an infringement of GDPR has occurred.
If you are located in the United Kingdom, you may have the right to lodge a complaint with the UK Information Commissioner’s Office.
We encourage you to contact us first at office@leoneisen.com so that we have an opportunity to address your concern.
10. Marketing Communications
If you subscribe to Fundable Circle communications, download content, register for updates, or otherwise consent to receive marketing communications, we may send you information concerning fundraising, startups, Fundable Circle, advisory services, educational materials, events, publications, and related services.
Every marketing email we send will provide a way to unsubscribe.
You can also request removal from marketing communications at any time by contacting office@leoneisen.com.
Unsubscribing from marketing communications does not prevent us from sending administrative or service-related communications that are necessary for an existing business relationship.
11. Security
We use reasonable technical and organizational measures designed to protect personal data against accidental loss, unauthorized access, misuse, alteration, disclosure, or destruction.
Our website and related information may also be protected through security measures provided by our hosting and technology providers.
However, no website, internet transmission, or electronic storage system can be guaranteed to be completely secure. You should therefore use reasonable care when deciding what information to transmit electronically.
12. Third-Party Websites and Services
The website may contain links to third-party websites or services, including scheduling platforms, social networks, payment providers, investor platforms, Amazon, LinkedIn, or other external services.
When you leave our website or interact directly with a third-party service, that provider may collect and process your information under its own privacy policy.
We are not responsible for the privacy practices of independent third-party websites or services.
13. Children
Fundable Circle is intended for entrepreneurs, founders, investors, business professionals, and other adults.
Our services are not directed to children under the age of 18, and we do not knowingly collect personal data from children through this website.
If you believe that a child has provided us with personal data, please contact us at office@leoneisen.com, and we will take appropriate steps to address the information.
14. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our website, services, technology, legal requirements, or data-processing practices.
When we make changes, we will publish the updated Privacy Policy on this page and revise the “Last Updated” date above.
Material changes may also be communicated through additional means where required by applicable law.
